STORECASH TERMS & CONDITIONS

These terms and conditions constitute a legally binding contract between The Good Guys and you in relation to StoreCash and StoreCash Offers.

Please read the following terms and conditions carefully before participating in a StoreCash Offer. The terms and conditions contain important information about StoreCash Offers and earning and using StoreCash.

A Digital Wallet must be downloaded by you for you to be eligible to earn and use StoreCash. By downloading the Digital Wallet or otherwise attempting to participate in a StoreCash Offer and/or claim StoreCash, you confirm that you have read, understood and agree to both these terms and conditions and The Good Guys Digital Wallet terms and conditions which are available at https://www.thegoodguys.com.au/storecash/wallet-terms-and-conditions.

1. StoreCash

(a) From time to time The Good Guys may offer customers StoreCash Offers on its website, in store, via a customer’s Digital Wallet, or via various communications including email, SMS, catalogue, or social media. StoreCash Offers are available for the Offer Period, and you must meet the Qualifying Conditions to be eligible to earn the relevant StoreCash.

(b) If you earn StoreCash, your Digital Wallet will be credited once with the StoreCash that you have earned. You can then use the StoreCash to purchase Products and services from The Good Guys, subject to these terms and conditions.

(c) In order to receive StoreCash you must sign up and download your Digital Wallet to your mobile device before you purchase the relevant Qualifying Product or otherwise participate in a StoreCash Offer.

(d) When signing up, please ensure that you enter all information carefully. You warrant to The Good Guys that all information provided by you is complete, true and accurate. You may not sign up for StoreCash on behalf of another person.

2. Communications

(a) By signing up to receive StoreCash, you agree to:

  • the collection, use and disclosure of your personal information as set out in The Good Guys Privacy Policy (as updated from time to time which can be accessed on The Good Guys’ website at www.thegoodguys.com.au/privacy-policy); and
  • • subscribe to marketing communications from The Good Guys, including in relation to the Digital Wallet and StoreCash Offers. If you have a Gold Service Extras membership and have previously opted out of Gold Service Extras Member Communications then, by signing up to receive StoreCash, you agree to receive Gold Service Extras Member Communications again.

(b) In order to receive StoreCash Offers and StoreCash Notifications via email, SMS or the Digital Wallet, you must continue to be subscribed to receive marketing communications from The Good Guys or continue to be subscribed to Gold Service Extras Member Communications.

(c) You can unsubscribe from marketing communications or Gold Service Extras Member Communications at any time, by following the unsubscribe instructions in the relevant communication or via the unsubscribe link in the ‘Details’ section of the Digital Wallet or by sending an email request to privacy@thegoodguys.com.au. However, please be aware that if you are not subscribed to either: (i) marketing communications from The Good Guys; or (ii) Gold Service Extras Membership Communications, you will not receive any further StoreCash Offers or StoreCash Notifications via email, SMS or the Digital Wallet

3. Earning StoreCash

(a) Individual product pages on The Good Guys website, and the StoreCash hub at www.thegoodguys.com.au/storecash, show which Products earn StoreCash pursuant to StoreCash Offers. StoreCash is not earned on any Product unless the StoreCash Offer is specifically advertised in relation to that Product.

(b) The following Products will never be part of a StoreCash Offer.

Excluded Products Details
Agency Brand Products Agency Brands include, but are not limited to Miele, Asko, AEG, La Germania, Neff, Loewe and certain Smeg and Fisher Paykel cooking products. The Good Guys team members can provide a current list on request.
Purchases from websites other than www.thegoodguys.com.au Excluded websites include, but are not limited to, The Good Guys eBay store or via The Good Guys Commercial website or business.
Purchases of gift cards, digital or e-gift products Gift cards, digital vouchers, gaming credits.
Products purchased for commercial purchases Purchases for or in the name of trusts, companies and businesses, or which are otherwise for commercial purposes including (without limitation) commercial or residential developers, builders, subcontractors, installers and resellers.

(c) If you buy 3 or more units of the same Qualifying Product, you only earn Store Cash on the first 3 units purchased.

(d) Where a StoreCash Offer requires you to purchase a Qualifying Product then, in order for you to earn StoreCash, payment for that Qualifying Product must be made by you in full, and the Qualifying Product collected by you or delivered to you, within 60 calendar days of order. If you arrange for delivery to take place within 60 calendar days of order but delivery does not take place through no fault of your own, you will still receive the relevant StoreCash, provided that you have paid in full before the deadline.

(e) We suggest that you retain your original The Good Guys tax invoice(s) with your mobile number as proof of purchase of Qualifying Products. If we cannot link your purchase to your Digital Wallet (for example because you have given us an incorrect email address), then we may need to use the invoice for proof of purchase and, if you cannot provide it, you may lose StoreCash that you would otherwise have earned.

4. Using StoreCash

(a) Where you earn StoreCash, the StoreCash that you have earned will be credited to your Digital Wallet within a maximum of 5 business days after the collection/delivery of the Qualifying Product. Where the Qualifying Conditions do not require purchase of a Qualifying Product, the StoreCash that you have earned will be credited to your Digital Wallet within 5 business days after satisfaction of the relevant Qualifying Conditions.

(b) StoreCash may be used by you for purchases from The Good Guys in store, online (only at www.thegoodguys.com.au) or over the phone, and can only be used in a single transaction.

(c) Unless another expiry period is stated in a StoreCash Offer (in which case that expiry period will apply), all StoreCash that you earn after 1 September 2023 expires ninety (90) calendar days after the date on which it is credited to your Digital Wallet. All StoreCash that you earn prior to 1 September 2023 shall have the expiry date specified in the Digital Wallet for that StoreCash reward.

(d) Each StoreCash> reward will appear separately in your Digital Wallet rather than being totalled into a single balance. Each StoreCash reward can only be used once and in one transaction although you can use multiple StoreCash rewards in a single transaction. No change or credit will be given for any unused balance of an individual StoreCash reward that is not used in full at the time of use.

(e) StoreCash that you have earned:

  • cannot be exchanged for cash; and
  • cannot be used for payment towards any Product that was purchased to earn the StoreCash.

(f) The following Products cannot be purchased using StoreCash.

(g) StoreCash is transferable and may be used by another person. To do this, forward the StoreCash to the relevant person. If you believe that your StoreCash has been stolen or subject to unauthorised access, please notify The Good Guys immediately.

5. How do you know if you have StoreCash available to use

(a) If you are subscribed to either: (i) marketing communications from The Good Guys; or (ii) Gold Service Extras Membership Communications, we will send you a StoreCash Notification notifying you that StoreCash has been deposited in your Digital Wallet and the expiry date. If you are not subscribed to marketing communications from The Good Guys or to Gold Service Extras Membership Communications, you will not receive StoreCash Notifications and you are responsible for checking the status of your Digital Wallet to know when StoreCash has been deposited. If you have enabled “notifications” in your Digital Wallet, you may receive a notification when StoreCash has been credited to your Digital Wallet depending on your mobile device’s operating system.

(b) To use StoreCash when purchasing a Product:

Over the phone Tell the The Good Guys team member the code and StoreCash PIN.

6. Removing the Digital Wallet from your Mobile Device

(a) In order to receive StoreCash you must sign up and download your Digital Wallet to your mobile device before you purchase the relevant Qualifying Product or otherwise participate in a StoreCash Offer.

(b) If your Digital Wallet is no longer installed on your mobile device, or is no longer functional or active because you have not enabled updates from Apple or Google or another relevant operating system, you will not receive any further StoreCash or StoreCash Offers in your Digital Wallet and any existing and unused StoreCash in your Digital Wallet at that time, or to which you were otherwise entitled, will be void and cannot be used.

(c) Please note that removing the Digital Wallet from your mobile device will not unsubscribe you from The Good Guys marketing communications or Gold Service Extras Member Communications. To unsubscribe from marketing communications, you will need to follow the unsubscribe instructions clause 2(c) of these terms and conditions.

7. Returning Products purchased using StoreCash

(a) If you return a Product that has been purchased by you using StoreCash, The Good Guys will provide you with a The Good Guys Store Credit for a value equal to the value of the StoreCash that was used to make the purchase, and the balance will be refunded to the other payment method used by you. 8. Liability

(a) Nothing contained in these terms and conditions shall be read or applied so as to exclude, restrict or modify, or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy or other obligation implied by any law (including without limitation the Australian Consumer Law) which cannot by law be excluded, restricted or modified.

(b) Except to the extent caused by The Good Guys’ negligence or breach of these terms and conditions, or as otherwise required by law, The Good Guys shall not be liable to you for any loss suffered by you to the extent caused by: (A) information that you have provided to The Good Guys in relation to your Digital Wallet or any StoreCash Offer being incomplete or inaccurate; (B) any unauthorised use of, unauthorised access to, or theft of, your Digital Wallet or StoreCash which takes place before you notify The Good Guys; (C) any technical issues with websites, applications, operating systems, Digital Wallets, or the internet, beyond the reasonable control of The Good Guys; (D) any breach by you of these terms and conditions or the Digital Wallet terms and conditions; or (E) anything outside of The Good Guys’ reasonable control and within your reasonable control.

9. General

(a) The Good Guys reserves the right to amend these terms and conditions at any time. Any amendment will take effect from the time that it appears in your Digital Wallet or you are otherwise notified. The terms and conditions which apply at the time that you participate in a StoreCash Offer are the terms and conditions which will apply to that StoreCash Offer and any resulting StoreCash.

(b) Any provision in these terms and conditions which is invalid or unenforceable in any jurisdiction is to be read down for the purpose of that jurisdiction, if possible, so as to be valid and enforceable, and otherwise shall be severed to the extent of the invalidity or unenforceability, without affecting the remaining provisions of these terms and conditions or affecting the validity or enforceability of that provision in any other jurisdiction.

(c) These terms and conditions are governed by the laws of Victoria, Australia.

10. Definitions

Agency Brand Product means a Product where The Good Guys acts as an agent on behalf of the manufacturer/supplier.

Digital Wallet means the digital “wallet” made available by The Good Guys for download by you, which (following download) is stored in either Apple Wallet or Google Wallet (or equivalent) on your mobile device and which is subject at all times to The Good Guys Digital Wallet terms and conditions which are available at https://www.thegoodguys.com.au/storecash/wallet-terms-and-conditions.

Gold Service Extras means The Good Guys Gold Service Extras membership program which is subject at all times to The Good Guys Gold Service terms and conditions available https://www.thegoodguys.com.au/gold-service-extras-terms-and-conditions.

Gold Service Extras Member Communications means all communications (including marketing communications) sent to Gold Service Extras members relating to their Gold Service Extras memberships.

Offer Period means the period during which StoreCash can be earned.

Product means a product available for purchase from The Good Guys, subject to the exclusions set out in these Terms and Conditions.

Qualifying Conditionsmeans the conditions stated in a StoreCash Offer that must be met in order to earn StoreCash.

Qualifying Product means a product on which StoreCash can be earned by purchasing that Product.

StoreCash means a reward in the form of a voucher with a set value and expiry date deposited in your Digital Wallet that can be used to purchase goods and services at The Good Guys in store, online (only at www.thegoodguys.com.au), or over the phone.

StoreCash Notification means an SMS or an email sent to you by The Good Guys notifying you that your earned StoreCash has been deposited in your Digital Wallet.

StoreCash Offer means an offer from The Good Guys for customers to earn StoreCash when meeting the Qualifying Conditions, and which is subject at all times to these terms and conditions.

The Good Guys means The Good Guys Discount Warehouses (Australia) Pty Ltd (ACN 004 880 657).
