KitchenAid Australia – Colour of the Year Utensils Gift with Purchase Promotion February 2026
Terms & Conditions
1. Information on purchasing Participating Products and how to receive a Gift forms part of these Terms and Conditions (Terms). These Terms apply to the KitchenAid Australia Colour of the Year Utensils Gift with Purchase Promotion February 2026 (Promotion) and submission of a claim to redeem a Gift is deemed acceptance of these Terms.
2. The promoter is KitchenAid Australia Pty Ltd (ABN 50 601 363 419) of 6-8 Billbrooke Close, Cameron Park NSW 2285, Australia, telephone 1800-990-990 (Promoter).
3. The Promotion will be open from 9:00am AEDT on Friday, 13 February 2026 and will close on 11:59pm AEST on Sunday, 10 May 2026 (Promotion Period). Purchases made outside the Promotion Period are invalid.
Definitions
4. For the purposes of these Terms:
a. Gift refers to 1 KitchenAid 6-Piece Utensil Set in the colour Spearmint (SKU KHH469OSSNAG).
b. Participating Product(s) refers to the KitchenAid KSM195 Artisan Tilt-Head Stand Mixer in the colour Spearmint (SKU 5KSM195PSASD). The Participating Product(s) are subject to stock availability.
c. Participating Retail Partner means any of the Australian retail stores who actively trade with KitchenAid Australia, including but not limited to:
i. JB Hi-Fi Limited;
ii. The Good Guys;
iii. Kitchen Warehouse Pty Ltd;
iv. Minimax Pty Ltd;
v. Bing Lee Electrics Pty Ltd;
vi. Myer Holdings Limited;
vii. David Jones Limited;
viii. Harvey Norman Holdings Ltd.
d. Proof of Purchase means an original tax invoice confirming Purchase of a Participating Product. This must include, at least, details of the Participating Product, the purchase price paid, the Participating Retail Store, and date that the Purchase was made during the Promotional Period.
e. Purchase means making full and final payment for a Participating Product, including by use of services such as Afterpay and Zippay where full payment is made during the Promotional Period and/or use of gift cards/store credits.
f. Website means the KitchenAid Australian website at kitchenaid.com.au.
Who can enter?
5. Entry is open to Australian residents aged 18 years and over (Eligible Claimants).
6. Employees, directors, management and contractors of the Promoter and other agencies, firms, retail staff or companies associated with the Promotion, and their immediate families, are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
7. By entering this Promotion you represent that you are eligible to enter.
How to enter the Promotion
8. (Website) For Purchases made through the Website, to enter the Promotion and be eligible to receive the Gift:
a. the Eligible Claimant must, during the Promotion Period, Purchase a Participating Product from the Website. The Gift will automatically be added to your cart at checkout. When Purchasing the Participating Product, Eligible Claimants will be automatically subscribed at checkout to receive updates and marketing communications from the Promoter;
b. having subscribed to receive updates and marketing communications from the Promoter, the Eligible Claimant will receive an email within 2 business days of their Purchase containing confirmation that the Gift will be dispatched to the delivery address used by the Eligible Claimant when Purchasing the Participating Product (the Gift Email);
c. the Eligible Claimant must remain subscribed to receive updates and marketing communications from the Promoter in order to receive their Gift Email and Gift; and
d. the Gift will be dispatched by the Promoter to the delivery address used by the Eligible Claimant when Purchasing the Participating Product within 15 business days of Purchase of the Participating Product.
9. (Participating Retail Partners) For Purchases made through Participating Retail Partners, to enter the Promotion and be eligible to receive the Gift:
a. the Eligible Claimant must, during the Promotion Period, Purchase a Participating Product in store or online from a Participating Retail Partner;
b. following Purchase, the Eligible Claimant must access the Registration Form via the Website at https://kitchenaid.com.au/pages/register-my-product and complete the requested details, including the Eligible Claimant's name, email, phone and address, the model number, colour and serial number of the Participating Product Purchased, Purchase date and invoice number by 11:59 pm AEST Wednesday, 10 June 2026. As part of completing the Registration Form, the Eligible Claimant must opt-in to receive updates and marketing communications from the Promoter.
c. if the Registration Form has been correctly completed by the Eligible Claimant, the Eligible Claimant will receive a Gift Email within 2 business days (see clause 8.b above for details relating to the Gift Email).
d. the Eligible Claimant must remain subscribed to receive updates and marketing communications from the Promoter in order to receive their Gift Email and Gift;
e. the Gift will be dispatched by the Promoter to the address used by the Eligible Claimant when completing the Registration Form within 15 business days of completing of Registration Form.
10. Eligible Claimants must claim their Gift by following the steps set out at 8 and 9 above and by no later than 11:59 pm AEST on Wednesday, 10 June 2026. Any claims received after this time will not be eligible to claim the Gift.
11. A maximum of one (1) Gift can be redeemed per Eligible Claimant.
12. The Promoter reserves the right to disqualify Eligible Claimants if proof of age, identity, residency or Proof of Purchase has not been provided on reasonable request from the Promoter, or the Eligible Claimant has not otherwise complied with these Terms. The Promoter may contact any Eligible Claimants to resolve any issues that may arise with respect to a claim for a Gift. If such issues are resolved to the reasonable satisfaction of the Promoter, the Eligible Claimant's claim will be accepted.
13. Purchases of Participating Products that are made outside of the Promotional Period are not eligible under this Promotion to receive the Gift. Similarly, any claims for a Gift are invalid if they:
a. fail to comply with any other requirements under these Terms;
b. incomplete, incorrect or incomprehensible; or
c. stolen, forged, mutilated or tampered with in any way.
14. The Promoter accepts no responsibility for illegible, late, lost, stolen or misdirected claims for the Gift. The Promoter does not accept responsibility for any person or third party which misrepresents itself as a Participating Retailer Partner or incorrectly claims that a Bonus Offer is available.
Other Terms
15. The Promoter's decision is final on all matters and no correspondence will be entered into.
16. The Promotion is not available in conjunction with any other promotion, offer or discount unless otherwise specified.
17. Commercial sales, second-hand purchases, refurbished products, trade seconds products, insurance claims, display models, purchases denoted “Clearance” (including seconds) or special offers are excluded from this Promotion, and any Participating Products purchased in these ways will not be eligible for the Gift.
18. In the event that the Promoter is unable to supply the Gift (or any part thereof), the Promoter reserves the right to supply an alternative Gift (or part thereof) of similar or greater monetary value.
19. The Gift is not transferable or exchangeable by the Eligible Claimant, nor can it be redeemed for cash. All other costs associated with the Gift are the responsibility of the Eligible Claimant.
20. The Eligible Claimant shall accept Gift as described in these Terms and acknowledges that the Promoter accepts no responsibility for any variation in value, or for any tax liabilities that may arise from claiming the Gift. The prices specified in these terms are inclusive of GST.
21. Any costs incurred by the Eligible Claimant associated with this Promotion, including making telephone enquiries in relation to the Gift, are the sole responsibility of the Eligible Claimant.
22. Eligible Claimants may only claim for a Gift in their own name and using their own personal details (i.e., their own address, contact details, etc.). A person must not claim a Gift to which another Eligible Claimant is entitled, whether on their behalf or otherwise. If there is a dispute as to the identity of an Eligible Claimant, the Eligible Claimant will be deemed to be the person who Purchased the Participating Product.
23. Nothing in these Terms limits, excludes or modifies, or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Consumer Law or similar consumer protection laws in Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion including, but not limited to, where arising out of the following:
a. any technical difficulties or product malfunction (whether or not under the Promoter's control);
b. any theft, unauthorised access or third party interference;
c. any claim that is late, lost, altered, damaged or misdirected (whether or not after the receipt by the Promoter) due to interference;
d. any tax liability incurred by a claimant; or
e. use of the Gift.
24. The Promoter collects and stores personal information (PI) disclosed by an Eligible Claimant in order to conduct the Promotion and otherwise for the purposes set out in this clause 25, and may, for these purposes, disclose an Eligible Claimant’s PI to third parties, including but not limited to the Promoter’s agents, contractors, service providers and, where required, Australian statutory or regulatory bodies. The Promoter’s provision of a Gift to an Eligible Claimant pursuant to these Terms is conditional on that Eligible Claimant providing this PI. In addition to any uses that may be outlined in the Promoter's privacy policy, if the Eligible Claimant opts-in by ticking the opt-in box at the time of submitting their claim, that Eligible Claimant consents to the information they submit being entered into a database of the Promoter and its agents and for this information to be used, unless otherwise advised, for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. All personal details of the Eligible Claimant will be stored by the Promoter and its agents and are subject to the Promoter’s privacy policy, see https://kitchenaid.com.au/pages/privacy-policy. Unless otherwise indicated by the Promoter or its agent, the Promoter or it’s agent may disclose PI overseas.
25. Claimants provide their consent under clause 25 until such a time as they withdraw their consent by giving notice to the Promoter. Claimants can opt-out, gain access to, update or correct any PI held by the Promoter by contacting the Promoter at the details listed in clause 2 of these Terms.
26. These Terms are governed by the laws of New South Wales. Claimants submit to the non-exclusive jurisdiction of the courts of New South Wales.
27. The Promoter may change these Terms from time to time, by posting the revised Terms (or a link to them) on the Promoter's Website. Eligible Claimants should regularly check the Promoter's Website for any changes. Eligible Claimants will be bound by the version of the Terms that applied at the time of their qualifying Purchase of a Participating Product.
28. This Promotion is subject to stock availability of the Participating Products.
29. If you have any dispute or complaint relating to the Promotion, the Eligible Claimant must contact the Promoter at the details listed in clause 2 of these Terms in the first instance. The Promoter will use its reasonable endeavours to respond to you within 21 business days to discuss a resolution in good faith.
