The Promoter of the Competition is The Good Guys Discount Warehouses (Australia) Pty Ltd, ABN 48 004 880 657, of 60 City Road Southbank, VIC 3006.

By submitting an entry to the Competition “you” acknowledge and agree to these Terms and Conditions.

The prize poli is valued at $17,445 AUD (at time of publishing 2nd November, 2023) consisting of 6 prizes:

• a major prize (“Samsung Prize”) (see details at clause 4 below);
• and 5 x runner’s up prizes, each a $1,000 The Good Guys digital Gift Card (“Gift Card Prize(s)”),
  (each referred to as “a Prize”).

The Samsung Prize is valued at $12,445 AUD and includes the below products and delivery to the winner as specified below:

Both the Promoter and Samsung reserve the right to substitute products included in the Samsung Prize with an alternative product to an equal or similar value if any the products are for some reason unavailable and, where practicable, the Promoter and/or Samsung will offer the winner a choice of alternatives.

The Gift Card Prizes and Samsung Prize are not transferable, exchangeable or redeemable for cash. Cash will not be awarded in lieu of any component. The Good Guys digital Gift Card is subject to the terms and conditions available at https://www.thegoodguys.com.au/gift-cards#termsSection

To be eligible to win a Prize in the Competition participants must:

• enter the Competition between 12:00am AEDT 02/11/23 and 11:59pm AEDT 14/11/23 by completing the entry form at www.thegoodguys.com.au/black- friday-sale, providing their name, email address, telephone number, and postcode, and describing in 25 words or less “Why are you excited to shop The Good Guys Black Friday sale this year?”; and
• opt-in to receive marketing material from The Good Guys by clicking the consent box in the entry form and remain opted in to receive marketing material from The Good Guys until the Competition is judged and the winner is notified 5pm AEDT 15/11/23.

Only one entry to the Competition will be accepted per person. Participation in this Competition is only open to Australian residents aged 18 years and over.

Employees of the JB Hi-Fi Group and Samsung and their immediate families and agencies associated with this Competition are ineligible to enter.

The winners will be the best valid entries as judged by the judging panel, having regard to skill, creativity, and originality on the 15/11/2023 at 3PM AEDT at 60 City Road Southbank, VIC 3006. The Samsung Prize will be awarded to the most skilled, creative and original answer by an eligible entrant and the Gift Card Prizes will be awarded to the most skilled, creative and original answers submitted by the next 5 eligible entrants.

The Promoter reserves the right to request that winners provide proof of identity, proof of age, proof of residency and/or proof of entry validity in order to claim a Prize. Whether evidence provided is sufficient is at the discretion of the Promoter who will act reasonably and in good faith.

If the winner of the Samsung Prize does not satisfy the requirements of these Terms and Conditions their Samsung Prize will be forfeited and another winner will be judged on the same criteria by the judging panel on 7/12/2023 at 3PM AEDT at 60 City Road Southbank, VIC 3006. This subsequent winner of the Samsung Prize will be notified by email on 8/12/2023 at 3PM AEDT. If this subsequent winner of the Samsung Prize does not satisfy all Terms and Conditions of this Competition no additional judging will be conducted and the Samsung Prize will be forfeited.

If a winner of a Gift Card Prize does not satisfy the requirements of these Terms and Conditions their Gift Card Prize will be forfeited and no further judging or award of the Prize will take place.

The Promoter’s decision is final and no correspondence will be entered into.

The winner of the Samsung Prize and the winners of the Gift Card Prizes will be notified by phone and email using the contact number and email registered to each winner’s entry form. The Gift Card Prize will be sent to the winner’s email address provided in the entry form on 15/11/2023.

The Promoter will notify the winner of the Samsung Prize as soon as reasonably practicable of the date that the Samsung Prize will be available for delivery to or collection by the winner, which will be after January 2024. The Samsung Prize must be received or collected in full by the winner within one month of notification by the Promoter to the winner of the availability for delivery or collection of the Samsung Prize. If the Samsung Prize is not received or collected in full by the winner within one month of notification by the Promoter to the winner of the availability for delivery or collection, the Samsung Prize will be forfeited.

The winners’ last name, initial and postcode will be published on https://www.thegoodguys.com.au/winners on 20 November 2023 and will be displayed on the website for a minimum of 28 days.

The Promoter’s privacy policy is available on The Good Guys’ website at https://www.thegoodguys.com.au/privacy-policy and contains information about how the Promotor will handle your personal information, and other information required to be disclosed to you under the Privacy Act. You should read this policy before providing any personal information to the Promoter. Your personal information will only be disclosed to any third party to the extent necessary to fulfil the Prize and for no other reason without your consent.

Nothing contained in these Terms and Conditions shall be read or applied so as to exclude, restrict or modify or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy or other obligation implied by any law (including, without limitation, the Australian Consumer Law) which cannot by law be excluded, restricted or modified.

The Promoter reserves the right to amend, cancel or suspend this Competition if an event beyond the control of the Promoter corrupts or affects the administration, security, fairness, integrity or proper conduct of this Competition or if such a change is required to ensure the safety of the Promoter or entrants. Such changes may include the timing of the judging and the conduct of any prize related activities. The Promoter will act reasonably and in good faith in making any such decision. Except to the extent caused by the Promoter’s negligence, or the Promoter’s breach of these Terms and Conditions, or as otherwise required by law, the Promoter will not be liable to any entrant for loss resulting from such action.

The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition. The Promoter’s legal rights to recover damages or other compensation are reserved and any winner found to be in breach of these Terms and Conditions or having engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition may be required to return any Prize received.

Except to the extent caused by the Promoter’s negligence, or the Promoter’s breach of these Terms and Conditions, or as otherwise required by law, the Promoter will not be liable for any loss suffered by an entrant or potential entrant to the extent:

• resulting from or connected with any inability of a person to submit an entry (on time or at all), or failure of the Promoter to provide an opportunity to enter or to receive an entry (on time or at all), or failure of a winner to receive a Prize, due to events outside of the reasonable control of the Promoter including, without limitation, as a result of problems with, or technical malfunction of, any software, telephone or computer network, equipment or systems or mail or courier service;
• resulting from or connected with any theft of, or damage to, a Prize after it has been delivered to the address provided by the winner or given to the winner in person;
• that arises from events outside of the reasonable control of the Promoter but within the reasonable control of the entrant or potential entrant; or
• that arises as a result of any breach of these Terms and Conditions by an entrant or potential entrant.
